1. Acceptance of Terms

By accessing or using the website located at asphaltpavingoxnard.com, or by engagingOxnard Asphalt Paving for any services, you agree to be bound by these Terms and Conditions. If you do not agree to these terms, please do not use our website or services. Oxnard Asphalt Paving reserves the right to modify these terms at any time. Continued use of the website or services after changes are posted constitutes acceptance of the revised terms.

2. Description of Services

Oxnard Asphalt Paving provides asphalt paving, sealcoating, repair, and related services to residential and commercial customers in Oxnard, CA and the surrounding Ventura County area. Services include, but are not limited to:

• Asphalt paving and resurfacing
• Asphalt sealcoating
• Crack sealing and pothole repair
• Parking lot paving and maintenance
• Driveway paving
• Grading and excavation
• Concrete curbing and sidewalks
• Drainage solutions
• Speed bump installation
• Parking lot striping
• Asphalt milling

All services are subject to a written contract or work order agreed upon by both parties before work begins. Services described on this website are for informational purposes and do not constitute a binding commitment to perform any specific scope of work.

3. Estimates and Pricing

Written estimates provided by Oxnard Asphalt Paving are based on the information available at the time of the site visit and are valid for 30 days from the date issued unless otherwise stated in writing. Estimates are not guaranteed prices. The final cost may change if:

• The scope of work changes after the estimate is issued at the request of the customer or due to conditions discovered during the work
• Hidden site conditions are uncovered that affect materials, labor, or access
• Material costs increase significantly between the estimate and the scheduled start date

Any changes to the agreed scope of work that affect price will be communicated to the customer in writing before additional work is performed.

4. Scheduling and Cancellation

Jobs are scheduled based on crew availability and weather conditions. Oxnard Asphalt Paving reserves the right to reschedule work due to weather, equipment issues, or other factors outside our control. We will provide notice of any rescheduling as soon as practical.

If the customer needs to cancel or postpone a scheduled job, please notify us at least 48 hours before the scheduled start time. Cancellations made with less than 48 hours notice may result in a fee to cover mobilization costs already incurred.

Asphalt and sealcoating work requires dry weather and minimum temperature thresholds to perform properly. Oxnard Asphalt Paving will not perform work under conditions that would compromise the quality of the finished surface.

5. Payment Terms

Payment terms are specified in the written contract or estimate for each job. Unless otherwise agreed in writing:

• A deposit may be required before scheduling larger projects. The deposit amount will be stated in the written estimate.
• Final payment is due upon completion of the work.
• Accepted payment methods will be communicated at the time of estimate. We reserve the right to require payment by check or cash for certain job types.

Accounts not paid within the terms stated in the invoice may be subject to a late fee. Oxnard Asphalt Paving reserves the right to pursue collection of unpaid balances, including filing a mechanics lien on the property as permitted under California law.

6. Customer Responsibilities

Before work begins, the customer agrees to:

• Clear the work area of vehicles, equipment, furniture, and personal property
• Ensure safe access to the work area for crew and equipment
• Notify Oxnard Asphalt Paving of any underground utilities, irrigation lines, or other buried features that could be affected by excavation or paving
• Obtain any required HOA approval before work is scheduled
• Keep the freshly treated or paved surface free of traffic for the curing period specified by our crew

Oxnard Asphalt Paving is not responsible for damage to underground utilities, irrigation systems, or other buried features that were not disclosed by the customer prior to the start of work.

7. Warranty Disclaimer

Oxnard Asphalt Paving stands behind the quality of our workmanship. Any warranty applicable to a specific project will be stated in the written contract for that project. In the absence of a written warranty, the following general terms apply:

• Workmanship defects reported within 1 year of project completion will be evaluated and addressed at our discretion.
• Cracking, settling, or surface changes caused by soil movement, tree root intrusion, heavy vehicle loads beyond the design specifications of the surface, or other conditions outside our control are not covered.
• Sealcoating and striping are maintenance services and are not warranted against normal wear from traffic, weather, and UV exposure.

EXCEPT AS EXPRESSLY STATED IN A WRITTEN CONTRACT, ALL SERVICES ARE PROVIDED "AS IS" WITHOUT ANY OTHER WARRANTY, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE.

8. Limitation of Liability

To the fullest extent permitted by law, Oxnard Asphalt Paving shall not be liable for any indirect, incidental, consequential, or punitive damages arising from the use of our services or website, including but not limited to lost profits, loss of use, or property damage not directly caused by our negligence. In no event shall our total liability to any customer exceed the total amount paid for the specific project giving rise to the claim.

9. Permits and Compliance

Where required, Oxnard Asphalt Paving will obtain the necessary permits for the work. The cost of permits is the responsibility of the customer and will be included in the project estimate. The customer is responsible for ensuring that the planned scope of work complies with any applicable HOA rules, deed restrictions, or covenants. Oxnard Asphalt Paving is not responsible for violations arising from HOA restrictions that were not disclosed before work began.

10. Website Use

Any legal action arising from these terms or the services provided by Oxnard Asphalt Paving shall be brought in a court of competent jurisdiction in Ventura County, California.

13. Modifications to These Terms

Oxnard Asphalt Paving reserves the right to update or modify these Terms and Conditions at any time without prior notice. Changes take effect immediately upon posting to this page. The effective date at the top of this page will reflect the most recent revision. Continued use of the website or services after changes are posted constitutes your acceptance of the updated terms.
